Welcome to M&M Automation. By accessing and using our services, you agree to comply with and be bound by the following terms and conditions.

2. Nature of Services

M&M Automation provides Software as a Service (SaaS) to automate business processes for the beauty and wellness industry. Services are delivered online and are based on the functionality of the Go High Level platform.


3. Payment Terms

Payment Methods:

All payments are processed through Stripe. Payment options include cards, bank transfers, and other methods supported by Stripe. M&M Automation does not accept all methods directly. Banking and payment details are securely stored by Stripe, not by M&M Automation.

Pricing and Fees:

Monthly subscription fees apply, along with applicable GST, service fees, and Go High Level top-up charges.

Billing Cycle:

Payments are recurring monthly. Customers will receive invoices through Stripe.

Advance Billing:

Invoices for monthly subscription fees are issued during the final week of each month. Payment is required by the first day of the following month to ensure uninterrupted service. For example, invoices for February are sent during the last week of January and are due by February 1.

Refunds and Disputes:

Payments are non-refundable unless otherwise agreed in writing by M&M Automation. Disputes regarding billing must be communicated in writing within 30 days of the invoice date. Any undisputed amounts remain due.


4. Order Process

Order Confirmation and Invoicing:

Orders are confirmed via a confirmation email. Recurring invoices are sent through Stripe unless otherwise arranged.

Cancellation Policy:

A 30-day written notice is required to cancel services. Cancellations must be submitted via email to the contact addresses provided. No refunds will be issued for cancellations except by prior agreement.


5. Delivery of Services

Services are delivered online within the capabilities of the software. While M&M Automation strives for consistent uptime, it is not responsible for interruptions caused by third-party providers, network outages, or other factors beyond our control.


6. Customer Responsibilities

Account Security:

Customers are responsible for maintaining the confidentiality of their login credentials. Notify us immediately of unauthorised access. M&M Automation is not liable for losses resulting from account misuse unless the breach occurs due to our systems.

Compliance with Laws:

Customers must comply with all applicable local laws when using our services.


7. Privacy and Data Protection

Data Collection and Use:

We collect relevant customer data, including name, email, phone number, and business address, to deliver services and set up accounts.

Third-Party Services:

Customer data may be shared with Go High Level, Stripe, Twilio, and Crazy Domains, as necessary to provide services.

Data Protection:

M&M Automation does not share customer data with third parties beyond those listed, except as required by law. Data protection complies with relevant privacy laws in New Zealand.


8. Limitation of Liability

Service Limitations:

Our services are provided "as is" and "as available." M&M Automation does not guarantee error-free performance or uninterrupted access.

Liability:

To the fullest extent permitted by law, M&M Automation shall not be liable for:

- Indirect, incidental, or consequential damages, including data loss or business interruption.

- Miscommunications via text-back automation.

- Missed appointments or losses resulting from failure to send reminders.


9. Dispute Resolution

Governing Law:

These terms are governed by the laws of New Zealand.

Dispute Process:

In the event of a dispute, parties agree to attempt resolution through mediation. If mediation fails, disputes will be subject to the laws of New Zealand.


10. Updates and Modifications

M&M Automation reserves the right to amend these Terms and Conditions. Customers will be notified via email at least 30 days before changes take effect. Continued use of services after this period constitutes acceptance of the revised terms.


11. Intellectual Property

Ownership:

All content and functionality of the M&M Automation platform are the exclusive property of M&M Automation and protected by international copyright laws.

Usage License:

Customers are granted a limited, non-exclusive license to use the services for internal business purposes. Modification, reproduction, or redistribution without written consent is prohibited.

Customer Content:

Any content created using our software remains the property of the Customer.

Infringement Claims:

M&M Automation respects intellectual property rights and will address any claims promptly.


12. Termination of Services

M&M Automation reserves the right to terminate services at any time without notice for violations of these terms. Customers must settle outstanding payments, and no refunds will be issued for unused portions of services unless otherwise required by law.


13. Force Majeure

M&M Automation shall not be held liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, cyberattacks, or governmental actions.
